On the issue of remand in prison arranged for the offense under Article. 416 to c.p., for the purpose of overcoming the presumption regarding the subsistence of the precautionary requirements referred to in Article. 275, co. 3, c.p.p., the distinction between 'historical' mafias and newly established formations is not relevant, as in both cases the presumption is overcome in the face of proof of the irreversible removal of the suspect from the criminal association, regardless of the continuing stability of the association (Cass. 9124/18).
