In the crime of stalking, the subjective element is integrated by the general intent, which it consists in the desire to engage in the conduct of threat and harassment in the awareness of the suitability of the same to the production of one of the events alternately provided by incriminating rule, is that, having for object a habitual crime of event, must be unitary, criminal expressing an intention that goes beyond the individual acts that comprise the typical conduct, although it can be carried out in a gradual manner, it is not necessary that the agent represents and desire from the beginning the realization of the series of episodes (Cass. 28340/19).
