L’art. 393 to c.p. It provides for a ground of justification based on the right of citizens to react arbitrary aggression of its rights perpetrated by public officials or public service by the Distributor or the civil servant, che può essere applicata anche nelle ipotesi putative di cui all’art. 59, co. 4, c.p., quando il soggetto abbia allegato dati concreti, suffraganti il proprio ragionevole convincimento di essersi trovato, a causa di un errore sul fatto, di fronte ad una situazione che, se effettiva, avrebbe costituito atto arbitrario del pubblico ufficiale (Cass. 4457/18).
